These terms and conditions shall apply to all transactions conducted via the Far Flung Craft website. Please read them carefully before placing your order and print a copy for future reference. With respect to goods or services purchased through this site, Far Flung Craft's liability, in any case, is expressly limited to replacement of defective goods, or, at our option, to the repayment of buyer with an amount equal to the purchase price of the goods. You acknowledge and agree that the limitations set forth above are fundamental elements of this agreement and the site would not be provided to you absent such limitations.
5. EXCLUSIONS AND LIMITATIONS
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS OF SECTIONS 6 AND 7 MAY NOT APPLY TO YOU.

Because Far Flung Craft has no control over such sites and resources, you acknowledge and agree that Far Flung Craft is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, accuracy, quality, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that Far Flung Craft shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.

Far Flung Craft, Googaw Charms, Frou-Frou Fabric Embellishment Kits, Fibers From Afar, Far Flung Craft's Blog and Newsletter, www.farflungcraft.com, and the logos, products, and service names are trademarks of Far Flung Craft. All other trademarks appearing on the Site are trademarks of their respective owners and our reference to them does not imply or indicate any approval or endorsement by their owners unless such approval or endorsement is expressly made.
9. NON-WAIVER
The failure of Far Flung Craft to exercise or enforce any right or provision of the T&C shall not constitute a waiver of such right or provision. If any provision of the T&C is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the T&C remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the T&C must be filed within one (1) year after such claim or cause of action arose or be forever barred.
10. HEADINGS FOR CONVENIENCE ONLY

12. SEVERABILITY
If any provision(s) of this Agreement, or any portion thereof, is found invalid or unenforceable, the remaining provision(s) will be enforced to the maximum extent permissible and the other provisions of this Agreement will remain in force.

This Agreement and any other terms and conditions of service on http://www.FarFlungCraft.com constitute the entire agreement between you and Far Flung Craft and govern your use of the Service.
14. DISCONTINUANCE OF SERVICE
Far Flung Craft reserves the right discontinue service to any user for non-compliance with these Terms and Conditions.
